Fair dealing and copyright in Canada


      There is eight different fair dealing purposes that does not infringe copyright, so you can use something copyrighted without getting in trouble for it depending on how you are using it and how much of it you use. Copy right is very important to protect someones work, yet there has to be ways that people can use certain works that are copy right without getting in trouble. I think that the way it is set up now is perfect, because people can use copy right novels, art work etc for educational purposes,  if they are working on a book report they can include some of the actual novel to quote it etc. Copy right is important, but if there wasn't ways that people could still use copy righted works a lot of great things wouldn't be known today. Being able to use copy righted works, also helps promote novels, art work, research papers etc!

      Say if a student was working on a certain novel in class, and the teacher was using it for educational purposes the teacher would be able to copy out on a handout 10% of the novel or a full chapter, whichever is greater. Which is a perfect amount to copy out of a novel for handouts, questions etc. If there was no fair dealing, a teacher would not be able to do that.

      Now if someone was writing a review, on a news paper article they would be able to legally copy the whole article as part of the research process and you may be able to include portions within your own work! Although if you are doing this you have to include the source of the information you are getting and, if it is provided, you have to list the author(s) or creator(s).

      If you are working on a private study of a poem or musical score, and the work is from a copy right protected work containing other such works; you can copy the whole entire musical score or poem. Yet, if you are planning on publishing your research anywheres, generally, you may NOT include a copy of the poem or musical score you are researching.

      If you are writing a report critiquing (criticism) of an audiovisual (tv show, or film) or a sound  recording, you may copy 10% of a sound recording or an audiovisual as part of your research. You may also include portions of what you have copied within your work, but you also HAVE to mention the source and if provided you must list the author(s) or creator(s) names.
